Since this devout assembly, gathered together by the Holy Spirit, exhorts us to treat with more diligent care whatever things are necessary for ecclesiastical discipline, let us, if it please you, brethren, in accordance with the precepts of the divine law and the enactments of the Nicene canons, so establish on a firm footing those matters which pertain to the regulation of ordinations, that, with the Lord's help, they shall abide for all ages, so that it may be lawful for no one, without peril to his own standing, to violate either the divine constitutions or the decrees of the Apostolic See; because the guilt of such transgressions will fall back upon us who administer the offices of the higher priesthood, if we are found slothful in the causes of God, since we remember what we ought to fear, namely how the Lord threatens the negligence of priests. For indeed he who enjoys the higher honor offends with the greater liability, and eminence of dignities makes the faults of sins more grievous. Therefore it must be guarded against above all that no one who has married a wife who was not a virgin should aspire to the sacred grades, just as it was prescribed before in earlier proceedings. He too is to be repelled who, contrary to the apostolic precepts, enters into the marriage of a second wife. Likewise those unskilled in letters, and also those who have suffered any losses of their members, and those who are from among the penitents, must not dare to aspire to the holy orders. Whosoever shall have appeared as a consecrator of such persons, shall himself undo his own deed; and what he committed unlawfully, or what he finds was admitted by his predecessors, he shall condemn, if he wishes to avoid his own peril; for we wish in no case to exercise the severity of vengeance. But whoever shall have offended in the causes of God by contumacy or by misdeed, or shall himself have refused to abolish what he wrongly did, shall find in himself whatever he did not cut off in another. And that this may henceforth be kept more firmly, if it please you, lend all of you your own opinions and subscriptions, so that by the synodal judgment access to wrongdoing may be more securely shut off. 3. By all the bishops and presbyters it was acclaimed: Hear, O Christ, life to Hilarus! it was said six times. These things we confirm, these things we teach! it was said eight times. These things are to be held, these things are to be observed! it was said five times. We give thanks for your teaching! it was said ten times. That these things may be observed forever, we ask! it was said fifteen times. Through the lord Peter, that they may be observed forever, we ask! it was said eight times. May this presumption never come to pass! it was said ten times. Whoever shall violate these things, shall find it in himself! it was said seven times. III. 4. And when silence had been made, Bishop Hilarus said: Moreover, brethren, new and unheard-of things, as has come to us through a sure report by letters sent from the Spains, are springing up from time to time in certain places, the seeds of perversities. For indeed some men think that the episcopate, which is granted only to preceding merits, is not a divine gift but a hereditary advantage, and they believe that the priesthood, like perishable possessions, can be passed on by right of bequest or testament. For many priests, when set at the threshold of death, are reported to substitute others into their own place, naming designated persons: that is, that a lawful election is not awaited, but the favor of the deceased is taken for the assent of the people. Consider how grave this is; and therefore, if it please you, let us also remove this license generally from the churches, lest, what is shameful to say, anyone should think he owes to a man that which is God's. But that what has been reported to us may be able to come also to your notice, let the writings of our Spanish brethren and fellow-bishops be read. 5. Paulinus the notary read aloud: To the most blessed pope Hilarus, to be venerated by us in Christ with apostolic reverence, Ascanius and all the bishops of the province of Tarraconensis. "What care your apostolate ..." and the rest, down to "... may you deign to confirm" (see above, Hilarus, letter 14, no. 1). 6. And when he read it, by all the bishops and presbyters it was acclaimed: Hear, O Christ, life to Hilarus! it was said ten times. May this presumption never come to pass! it was said six times. The things that are God's cannot be given by a man! it was said six times. Through the lord Peter, that they may be observed forever! it was said five times. That these things may be safeguarded, we ask! 7. Bishop Hilarus said: Read. Paulus the notary read aloud: The holy Nundinarius, bishop of the city of the Barcelonians, and the rest, down to "... his merit does not waver" (see above, Hilarus, letter 14, no. 2). And when he read it, Bishop Probus, rising from the assembly, said: That was permitted, this was not permitted; God grants successors; by your authority resist this matter through your apostolate! 8. Bishop Hilarus said: Run through what you had begun. Paulus the notary read aloud: "Since indeed all the clergy and people ..." and the rest, down to "... our true lord, and apostolic pope!" (see above, Hilarus, letter 14, nos. 2 and 3). IV. 9. Bishop Hilarus said: Let another letter be read. Paulus the notary read aloud: To the most blessed lord, to be venerated by us in Christ with apostolic reverence, pope Hilarus, Ascanius and all the bishops of the province of Tarraconensis. "Even if there existed no necessity ..." and the rest, down to "And the subscription." May the divine eternity preserve with continual age your holy apostolate as it prays for us! (see above, Hilarus, letter 13). 10. By all the bishops and presbyters it was acclaimed: That these things may be amended, we ask! it was said six times. That these things may be cut away, we ask! it was said seven times. That discipline may be preserved, we ask! it was said eight times. That antiquity may be preserved, we ask! it was said seven times. That discipline may be preserved, we ask! it was said five times. That the canons may be guarded, we ask! it was said seven times. That it may be avenged upon the presumptuous, we ask! it was said seven times. May the apostolic ordinance be preserved unimpaired! it was said eight times. Hear, O Christ, life to Hilarus! it was said five times. Worthy pope, worthy teacher! it was said eight times. V. 11. Bishop Hilarus said: Having received the things that have been read, brethren, now declare your particular opinions concerning all matters, with God inspiring you. Maximus, bishop of the church of Turin, said: In keeping all the disciplines that pertain to sacred ordinations, I bind the more firmly the profession of my own opinion, that nothing of those things which are forbidden is ever to be done by me. Concerning the rest, I judge that whoever shall have done such things, or shall have refused to cut away things detected in the churches, let him know that he will render up grave causes in the judgment of the Apostolic See, in which it will be necessary for him to undergo sentence. Ingenuus, bishop of Embrun, said: For me too there is the same opinion concerning all matters, by which I bind myself, that nothing of those things which are forbidden may ever be attempted by me, because I know my standing and my profession. Concerning the rest I also judge that whoever shall have appeared as a transgressor of the statutes, let him know that he is ensnared in the toils of the ecclesiastical rule, and incurs the liability of the Apostolic See. Paulus, bishop of Aquaeviva, said: I too bind myself by a like law, and concerning the rest, who shall have been transgressors, I likewise judge: that it be not permitted to them without peril to themselves to attempt anything of the sort which deservedly ought to be punished. Primus, bishop of the church of Atella, said: This I too judge ought to be observed. Palladius, bishop of the church of Salpi, said: I promise that I will do nothing against ecclesiastical discipline or the statutes of the holy canons. Tiberius, bishop of the church of the Sabines, said: I profess that I keep the statutes of the Apostolic See in all things, and that, if in my church I shall detect any of the clergy, against the precepts of the holy canons, either to have married a woman or to have two wives, he is to be separated from ecclesiastical office. By all the bishops it was said: We all follow the opinions of the brethren, we all confirm them and decree that they are to be observed. - Hear, O Christ, life to Hilarus! it was said six times. The things that have been wrongly admitted, let them be corrected through you! it was said eight times. What is not permitted, let it not be done! it was said eight times. 12. Hilarus, bishop of the church of the city of Rome, presiding over the synod, said: Since we decree that the form of the present definition, which is according to the opinion of the statutes of the holy fathers, should come to the notice of all the churches, lest through his own ignorance it should be permitted to anyone to do what is not permitted, the diligence of the notaries shall take care to issue the proceedings.
