TO PASSIVUS, BISHOP OF FERMO. He directs Passivus to consecrate a monastery in honor of Saint Savinus, according to the customary formula. Gregory to Passivus, Bishop of Fermo. Proculus, deacon of the Church of Asculum [Ascoli Piceno], has informed us by a petitionary statement that, out of his own devotion, he has founded a monastery on the Gressian estate, which is under his own jurisdiction, and that he desires it to be consecrated in honor of Saint Savinus the martyr. And therefore, most dear brother, if the aforesaid construction lawfully stands within your diocese, and it is established that no body has been buried there, then, once the lawful endowment has first been received -- that is, one conduma [a unit of estate land with its dependent cultivators] [...] -- [the remainder of this letter is interrupted in the source]. But upon inquiring, we have learned that they were by no means brought to your knowledge. Therefore the very document that was set before us we have caused to be appended below. And so, when everything has been examined and discussed, if those things prove, as has been reported, to be with you in manifest truth, we wish you to approach our brother and fellow bishop Marinianus, and to exhort him by every means that he ought to appoint those who are recognized to have a concern in carrying out the affairs of that same Church, so that, all things having been weighed with the aforesaid man concerning the matters that have been set in motion, they may settle them between themselves with ecclesiastical tranquillity. But if they choose to resist, let your Experience press forward that judgment proceed; and whatever is determined by the sentence of the examiners between them ought to be carried out and completed by your execution, lest the poverty of that same Church, delayed by long-drawn-out postponements, be aggravated by various losses, as it already asserts has happened. He has also indicated to us that a certain bishop Exuperantius, with rash audacity, has built an oratory in his diocese, and has presumed to dedicate it contrary to custom without the authority of a precept, and has not feared to celebrate public masses there. It befits you to correct this matter with the utmost speed and strictness, so that you do not permit any such thing to be attempted further. As for the oratory which you find to have been built by an incompetent person, we wish it to be restored to its proper bishop; if the matter, as has been stated, proves to be so, let it without any delay be set right, because it is not permitted to deviate from what has once been determined.
